1. Who We Are
Noir Label Stock ("we," "us," "our") is operated by M. Janee Photography LLC d/b/a Noir Label AI. These Terms of Service ("Terms") govern your access to and use of noirlabel.photos (the "Site") and any assets, subscriptions, or credit packs purchased through it (the "Service").
2. Acceptance of Terms
By creating an account, purchasing a subscription or credit pack, or downloading any asset from the Site, you agree to be bound by these Terms and by our License Terms. If you do not agree, do not use the Service.
3. Accounts
You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account.
4. Subscriptions, Credits & Billing
Subscription plans renew automatically on a monthly or annual basis at the price shown at checkout, until cancelled. Unused credits roll over according to the limits stated on the Pricing page for your plan; unused credits are not refundable or redeemable for cash. Credit packs are one-time purchases and do not renew. All payments are processed securely by Stripe. We do not store your full card details on our servers.
5. Cancellations & Refunds
You may cancel your subscription at any time from your account dashboard's billing portal. Cancellation stops future renewals; it does not retroactively refund the current billing period. Because assets are delivered instantly as digital downloads, purchases and subscription charges are generally non-refundable once a download has occurred, except where required by law.
6. License to Use Assets
Downloading an asset grants you a license to use it under the terms described on our License Terms page, based on the license tier (Standard or Extended) attached to your purchase. Ownership and copyright of all assets remain with Noir Label AI. Reselling, redistributing, or sublicensing raw, unmodified assets as stock content is not permitted under any license tier.
7. Acceptable Use
You agree not to use the Service to: violate any law; infringe on the rights of others; misrepresent the source or ownership of any asset; or attempt to circumvent access controls, credit limits, or licensing restrictions.
8. Availability & Changes
We may update, modify, or discontinue features of the Service, including pricing and plan structures, at any time. Material changes to these Terms will be reflected by updating the effective date below.
9. Disclaimer & Limitation of Liability
The Service and all assets are provided "as is" without warranties of any kind. To the maximum extent permitted by law, Noir Label AI is not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
